My work permit was refused or is at risk: A work permit for a job offer
Routes people usually look at
1
An employer-specific work permit supported by an LMIA
The employer gets a Labour Market Impact Assessment from Employment and Social Development Canada showing that hiring a foreign worker is needed.2
An LMIA-exempt work permit
For example under a trade agreement, an intra-company transfer, or another exemption code. These have their own conditions.3
Provincial or federal programs
That may lead to permanent residence later, if the job is skilled.
What’s usually involved
- Confirm whether the job needs an LMIA or falls under an exemption.
- The employer applies for the LMIA, or submits the offer of employment through the Employer Portal for an exempt job.
- You apply for the work permit, online or, in some cases, at the port of entry.
- Give biometrics and, if required, complete a medical exam.
- If approved, the permit is issued for that employer and job.
Documents you’ll typically need
Timing
Timing depends on whether an LMIA is needed, where you apply from, and how complete the application is. Check IRCC’s processing times page.
Common pitfalls
- Paying for a job offer or an LMIA. This is not allowed and can be fraud
- A job description that does not match your experience
- Working for a different employer than the one named on the permit
- Applying at the border when you are not eligible to
