Routes people usually look at

  1. 1

    What to do today

Ask to speak to a lawyer. Keep any papers the Canada Border Services Agency (CBSA) gave you. Give the lawyer your full name, date of birth and any immigration numbers.
  2. 2

    Release at your detention review

You have the right to a review by the Immigration Division within 48 hours, or without delay after that. Then there is a review within seven days. After that, there is one at least every 30 days.
  3. 3

    Release on conditions

For example: reporting to the CBSA, living at a set address, a cash deposit, or a guarantee from a bondsperson. A bondsperson is someone who promises you will follow the conditions.
  4. 4

    A Federal Court review

Of a detention decision, in some cases. The deadline is usually 15 days after you are told of the decision.
What’s usually involved
  1. Ask to speak with a lawyer. Give them your name, date of birth and any immigration numbers.
  2. Tell the Board if you need an interpreter.
  3. Think of someone who could be your bondsperson.
  4. Attend the review, usually by video, and answer questions truthfully.
  5. If you are released, follow every condition exactly.

Timing

The law sets fixed timelines for reviews. You may expect to be detained, for example because the CBSA asked you to report. If so, speak to a lawyer before that appointment.

Common pitfalls
  • Giving names or details that differ from earlier records
  • Not knowing that the member asks if you are likely to show up for removal, if removal is ordered
  • Breaking release conditions, which can lead to detention again and loss of a deposit
  • Missing a CBSA appointment out of fear of detention
